The BABINGTONS online shop was created for the sale to private consumers of teas and infusions, teaware, gourmandise and selection of gift packs in compliance with Italian regulations on distance contracts.

The sale is governed by these General Conditions, which are to be considered an integral and substantial part of the contract of sale. You are therefore urged, before placing your order, to read carefully the terms and conditions of sale as identified above and the information contained therein and to print them out or save them on another durable and accessible medium.

Any changes or new conditions of sale will be promptly reported to the Customer, will be effective upon publication on the site, and will apply only to sales completed after publication.

Submission of the order by the Customer shall be considered as acceptance of the conditions of sale in effect at that time.

Art. 1 – Conclusion of the contract

The order sent by the Customer to the online shop BABINGTONS must contain the elements necessary for the identification of the Customer and the products ordered as well as the indication of the place of delivery, under penalty of nullity. Babingtons online shop will send the Customer, by e-mail, a confirmation of receipt of order, containing a reference to the applicable terms and conditions of sale.

Art. 2 – Availability and delivery

The BABINGTONS online shop is committed to accepting orders within the limit of available stocks of goods.

BABINGTONS is committed to reporting products unavailable for purchase through the designation of “Temporarily Unavailable” or “Out of Stock.”

In the event that, due to a data error, the product becomes unavailable after placing the order, customer service reserves the right to contact the customer to propose an item of equivalent quality and price as a replacement. In the event that this is not possible, or in the event that the customer does not want substitutions, the customer can decide whether to wait for new availability or cancel the order for that item at no additional cost. In any case, the cost will be charged only for the value of the goods actually available.

In each form of payment, the credit/debit currency corresponds to the currency on the day of payment.

The BABINGTONS online shop delivers the product(s) ordered by the Customer, subject to the conditions expressly stated in the shopping cart section within the site.

Art. 3 – Payment
3.1 To pay the price of the products and the related shipping costs you can follow one of the methods indicated on the order summary/payment page.

3.2 In the case of payment by credit card, financial information (e.g., credit/debit card number or date of its expiration) will be forwarded, via encrypted protocol, to PayPal or other banks, which provide the relevant remote electronic payment services, without third parties being able, in any way, to access it. Such information, moreover, will never be used by the Seller except to complete the procedures relating to your purchase and to issue refunds in the event of any returns of products, following the exercise of your right of withdrawal, or if it is necessary to prevent or report to the police the commission of fraud on https://www.babingtons.com/. The price for the purchase of the products and the shipping costs, as indicated in the order form, will be charged when the order is concluded.

 Article 4 – Shipping and delivery of products
Shipping, unless otherwise specified, is via Express Courier in 2-4 business days after receipt of payment. Delivery to the Islands may take a few days longer. Upon successful shipment, you will receive a shipping confirmation e-mail indicating the Courier used and the tracking number so you can track your shipment directly on the courier’s website.

Article 5 – Right of Withdrawal

 The Customer has the right to withdraw from the contract, according to Legislative Decree May 22, 1999, no. 185, without any penalty and without specifying the reason, within 14 days of receipt of the goods, in accordance with fairness and good faith, upon notification by email to TEA@BABINGTONS.COM In the communication, the Customer must indicate the product or products for which he intends to exercise the right of withdrawal.

In accordance with the provisions of the law, BABINGTONS will provide in the manner and on the terms that will be agreed in advance with the Customer, unless its own waiver, a refund of the amount paid or replacement with another product.

The written communication, should contain:

  • The manifestation of willingness to avail oneself of the benefits granted by the law;
  • The indication of the product purchased;
  • Copy of the original sales order receipt which must be in your possession;
  • In case of partial withdrawal, specification of items
  • The details of the bank details on which to obtain the transfer (IBAN Code – Current Account of the buyer).

 
The right of withdrawal applies only to goods undamaged at the time of return.


Art. 6 – Timing and manner of reimbursement

8.1 Reimbursement will be made by the Seller as soon as possible, and in any case within 14 (fourteen) days from the date on which the Seller was informed of the decision to withdraw from the contract. The Seller will make the refund using the same means of payment used for the initial transaction, unless otherwise notified, in case of cash on delivery payment the order will be cancelled and nothing will have to be paid by both parties.

8.2 If there is no correspondence between the recipient of the products indicated in the order form and the person who has made the payment of the sums due for their purchase, the refund of the sums, in the event of the exercise of the right of withdrawal, will be carried out by the Seller, in each case, against the person who made the payment.

8.3 In case of exercising the right of withdrawal will be borne by the customer the shipping costs, including liability in case of loss or damage of products.

Art. 7 – Returns

If an item is received damaged in transit, the Customer does not bear the consequences, as all goods travel at our risk. We ask you to help us improve service by accepting parcels by signing “with reservation.”

Art. 8 – Prices and payment methods

Prices listed on www.babingtons.com, are in euros and include VAT. Transportation costs are excluded.
The prices charged are those shown on the site at the time of order. The prices of individual products are subject to change and, therefore, the prices from time to time indicated on the site, cancel and replace the previous ones. The price of the purchased products, together with the cost of home delivery, must be paid by the Customer when ordering online, by credit card. Documentation will be issued by BABINGTONS Ltd. at the time of delivery. You can issue invoice ONLY to companies with Italian VAT number: if you want invoice, it must be expressly requested before payment. You can indicate billing information within the order summary page. This option is only possible until the order has been submitted. Once taken over by the system, it will no longer be possible to request an invoice.

Article 9 – Warranties and Liability

BABINGTONS within the limits of availability as governed above, warrants that products equal to those shown and described on the site will be delivered. BABINGTONS Ltd. guarantees compliance with all regulations regarding the storage of products until delivery to the place specified in the order. Manufacturer’s responsibility applies to all products sold. In the case of packaged products, the manufacturer is also responsible for the truthfulness and completeness of the information on the packages. The pictures on the site are provided to the Customer to facilitate product recognition; due to variations in packaging by the manufacturer, the pictures may not accurately reflect the appearance of the delivered product.

Article 11 – Disputes and applicable law

Civil disputes concerning the application, execution and interpretation of the distance sales contract shall be subject to Italian jurisdiction and the Court of Rome shall have jurisdiction. Contracts entered into at a distance with BABINGTONS Srl are governed by Italian law and, as far as, not expressly provided for, the relevant legal regulations apply.
